Depending on the theoretical frame used by scholars, the perception of a state, at the time of increased globalization is really different. Its role, its place in international society, its obligations and what jeopardizes it, gets completely antagonist answers. Between those who believe that the state is outdated, and those who are convinced that it is on the contrary more relevant than ever, the role of the state is an issue that deserves to be discussed. Among all the questions it carries, the problem of its sovereignty is surely a subject of debate. The way a state's sovereignty is thought in international relation theory, is based on the Westphalian system, from the Westphalia treaty signed in 1964. It ended the Thirty Years War between European states and put the basis of the state's sovereignty as we know it. It claims that the state is sovereign in its own territory, where it implements its own rules and that no other state can interfere in this process. Since 1648 however, the scholars have noticed an erosion of sovereignty.

[...] The state is also the only way to guarantee the protection and the rights of its citizens, inside or outside its territory. And we cannot forget that according to constructivist, the behavior of the state on the international scale is created within its border, by the values and objectives of the dominant group. As a consequence, as long as the citizenship will remain the primary allegiance of the people, the state will continue to be legitimated. The territory is still the area defined and protected by a state. [...]
[...] The state always decided as the last resorts. The increase of economic cooperation had led to a transfer of competencies between the state and supranational organization. In the case of the European Union, the deepening of the integration (although not in all fields) is benefiting to the states by protecting them and by making them more competitive (subvention for the agriculture by the CAP). As a consequence, if even the international system recognizes the state, and need it to act, it seems that it is surely not an outdated concept. [...]

[...] Moreover, the culture is for some scholars, also part of the state's sovereignty, and when we consider the Americanization and the development of a global mass culture inspired by liberal occidental idea of uniformization, we have to acknowledge that is speak in favor of the erosion of the state. Fukuyama's of history” perfectly summarizes this tendency. The monopoly of the legitimate violence use to be another privilege of the state. However it is jeopardized when nations have to cope with international terrorism or internal guerilla. [...]
