We examine the impact of the illegal download of music on the music industry. The subject is of topical interest and it will be interesting to analyze the impact of the download on the music industry and the position of the various actors. Our analysis proceeded in three segments. Initially, we drew up a bibliography that enabled us to know the bases of the actual faintness, the figures of the evolution and also the position of the various actors. In the second part, we drew up a questionnaire according to our requirements, which we submitted to a hundred people, without taking account of the age, the socioprofessional category or of the standard of living. Finally, with an aim of perfecting our analysis, we had opportunity of questioning two professionals of the music: a record dealer, and a group "mixing" on illegally downloaded titles.
[...] But how these gates of download in self-service on Internet can continue to exist? The reason is simple: an Internet user places a file in one of the folders of the software, and thus, all the Internet users can download it. These software's have been create to facilitate the sharing of file between Internet users (studies, reports/ratios but their use quickly skidded, and it's now the industry of the disc which suffer of the consequences. Moreover, this software Peer To Peer generates advertizing revenues evaluated to million Euros. [...]
[...] The fulgurating evolution of the paying download is partly due to the lawsuits brought with the Internet users by the recording companies. These lawsuits, estimated at 7000 today according to the IFPI, are promoted more and more, and are apparently not close to being stopped. It should be known that in France for example, jurisprudence condemns contravener to a maximum fine of 300.000 supplied with a custodial sentence which can go up to 3 years. We could see that at the conclusion of our investigation by questionnaire, that the questioned people were not informed any of the incurred sorrow. [...]
[...] However we can't deny the effort made for three years. But there are still “holes in the catalogs”, recognizes Stanislas Hintzy, managing director of OD2 France[7]. But, according to him, the public sees on its screen the emerged part of the iceberg. A music download service on line does not have anything in common with peer-to-peer. The technical constraints (security of the contents, sound quality of the titles proposed) are definitely much important. For the managing director of OD2 France, the encountered difficulties have to be classified in three categories. [...]
[...] Indeed they will be able from now to create their own site of paying download without passing by the recording companies when CD will completely disappeared. Thus, they will be able to sell their less expensive music directly to the Internet users, like the famous singer Prince[9] would like to do DOWNLOAD, OFFICE OF RECRUITEMENT OF THE RECORDING COMPANIES To download mp3 permits to have an idea of the product before the purchase. Indeed, the users indicated that they wished they be able to listen to the musical productions in order to decide my heart and conscience, that the author deserves my money”. [...]
[...] What do you think of the paying download as a new mode of distribution? It is an exit to avoid trampling the work of the artists and people who work in the culture, the music, the image or the cinema. That's mean respecting this work; it really is a commercial exit. It can also be a new mean of making trade, by splitting the album that will make it allow to precisely choosing what we want to buy and safe money. [...]
